Specific charges faced by Bouygues, Laing O’Rourke and EDF subsidiary yet to be announced

Three companies working on the Hinkley Point C project have been told they will be prosecuted after the death of a worker on site.

Site supervisor Jason Waring died in a “construction incident” after sustaining fatal injuries on 13 November 2022.

On Friday, the Office for Nuclear Regulation (ONR) notified NNB Generation Company Ltd, Bouygues Travaux Publics SAS and Laing O’Rourke Delivery Limited that they would face charges.

Hinkley Point C is the new nuclear power station under construction near Bridgwater, Somerset.

Contractors Bouygues Travaux Publics and Laing O’Rourke are joint venture partners in BYLOR JV, which is delivering the main civil engineering works on the scheme.

NNB GenCo is a subsidiary of French energy firm EDF and was created to build and operate Hinkley Point C, as well as the proposed Sizewell C scheme in Suffolk. It is the principal contractor at Hinkley.

The decision to begin legal proceedings comes after an investigation by the ONR, which regulates the UK’s nuclear sector.

It said that details about specific charges, as well as the location and date of the first court hearing, would be announced once they are finalised.

A spokesperson for Hinkley Point C said: “Safety is our overriding priority and the project has fully co-operated with the ONR investigation. 

“We continually seek to develop and enhance our safety arrangements on site to keep our people safe. Our thoughts remain with the family, friends and colleagues of Jason.”

A spokesperson for BYLOR said: ”We have been informed by the Office for Nuclear Regulation that they intend to take action regarding a fatal accident that occurred on Hinkley Point C in 2022.

“BYLOR has cooperated at every step of the ONR’s investigation into the tragic death of Jason Waring. We are awaiting the written findings of the ONR and will continue to cooperate with the process. Our thoughts remain with Jason’s family, friends, and his colleagues.”
